Terms of Service

All information you add to your collection — including card details, notes, images, and projects — remains your property and is private by default.

By uploading or submitting content to the platform, you grant us a worldwide, non-exclusive, royalty-free license to:

• Store, process, and display your content as necessary to provide our services
• Create anonymized, aggregated data for platform improvements
• Use your content for any future sharing features you explicitly enable

We collect and process personal information as described in our Privacy Policy, including:

• Account information (name, email address)
• Collection data you add to the platform
• Payment information (if/when paid features are implemented)
• Usage data and analytics

Data retention periods vary by data type and will be detailed in our Privacy Policy.

• All payments are processed through PCI-compliant third-party processors (Stripe for web, Apple for iOS)
• We do not store credit card information on our servers
• Prices are in USD unless otherwise specified
• You are responsible for all applicable taxes
• Accounts terminated for Terms violations forfeit any refund rights

Premium is available as a monthly ($10/month) or annual ($99/year) auto-renewable subscription. For a limited time, Founding Member pricing is available at $5/month or $50/year and is locked in for the life of your subscription.

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. The renewal charge is the same as the original subscription price unless you have been notified of a price change in advance.

For purchases made through the App Store, payment is charged to your Apple ID account at confirmation of purchase. For purchases made on the web, payment is processed through Stripe. Your subscription begins immediately upon successful payment.

You can manage or cancel your subscription at any time:

• On iOS: Go to Settings → Apple ID → Subscriptions
• On web: Go to Settings within the app and click "Manage Subscription"

Cancellation takes effect at the end of the current billing period. You retain full access to premium features until then. No partial refunds are issued for unused time within a billing period.

Purchases made through the App Store are subject to Apple's refund policy. Web purchases made through Stripe are non-refundable except as required by applicable law.

We may change subscription pricing from time to time. You will be notified in advance of any price increase. Continued use of the subscription after a price change takes effect constitutes acceptance of the new price. Founding Member pricing, once locked in, is not subject to price increases for the duration of your continuous subscription.

If a free trial is offered, any unused portion of the free trial period is forfeited when you purchase a subscription.

If your subscription expires or is canceled, your account reverts to the free tier. All existing cards and collections are preserved — no data is deleted. However, you will not be able to add new cards if your collection exceeds the 200-card free tier limit, and premium-only features will no longer be accessible until you resubscribe.

All platform content, features, functionality, and technology (excluding user content) are owned by The Smarter Collector LLC and protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

We respect intellectual property rights. To report copyright infringement, contact our DMCA agent at chris@thesmartercollector.com with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• Statement of good faith belief
• Statement of accuracy under penalty of perjury
• Your physical or electronic signature

We will terminate repeat infringers' accounts.

Before filing any legal action, you agree to contact us at chris@thesmartercollector.com to attempt informal resolution.

If informal resolution fails:

• All disputes shall be resolved through binding arbitration in Massachusetts
• Arbitration shall be conducted under AAA Consumer Arbitration Rules
• Each party bears their own costs unless the arbitrator determines otherwise
• Small claims court actions are exempt from arbitration

You waive any right to bring claims as a class or collective action.

These Terms are governed by Massachusetts law, without regard to conflict of law principles.

These Terms and our Privacy Policy constitute the entire agreement between you and The Smarter Collector LLC.

If any provision is found unenforceable, the remaining provisions continue in full effect.

We are not liable for delays or failures due to causes beyond our reasonable control.

You may not assign these Terms. We may assign our rights to any successor or acquirer.

We may update these Terms at any time. Continued use after changes constitutes acceptance.
